Dokokin muhalli dokokin kare muhalli.[1] Dokar muhalli ita ce tattara dokoki, ka'idoji, yarjejeniyoyi da doka ta kowa da ke jagorantar yadda mutane ke hulɗa da mahallinsu.[2] Wannan ya haɗa da ka'idojin muhalli; dokokin da ke kula da kula da albarkatun kasa, kamar gandun daji, ma'adanai, ko kamun kifi; da batutuwa masu alaƙa kamar kimanta tasirin muhalli. Ya bambanta da dokokin muhalli na kafofin watsa labarai (misali, dokokin iska ko ingancin ruwa), dokokin kula da sinadarai suna neman sarrafa gurbataccen (mai yuwuwa) da kansu. Irin waɗannan dokoki na iya ƙuntata kwanakin girbi kifi ko wasa, yawan dabbobi da aka kama ga kowane mutum, nau'in da aka girbe, ko makamai ko kayan kamun kifi da aka yi amfani da su. Irin waɗannan dokoki na iya neman daidaita buƙatun dueling don adanawa da girbi da kuma sarrafa muhalli da yawan kifi da wasan. Dokokin wasan na iya samar da tsarin doka don tattara kudaden lasisi da sauran kudade waɗanda ake amfani da su don tallafawa kokarin kiyayewa da kudi samun bayanan girbi da aka yi amfani da su a aikin kula da namun daji.
Ka'idoji

Ka'idodin da aka tattauna a ƙasa ba cikakkiyar jerin ba ne kuma ba a gane su ko kuma a yarda da su a duniya ba. Duk da haka, suna wakiltar muhimman ka'idoji don fahimtar dokar muhalli a duniya.
Ci gaba mai dorewa

Tunanin zamani na ci gaba mai ɗorewa shine batun tattaunawa a taron Majalisar Dinkin Duniya na 1972 kan Muhalli na Mutum (Taron Stockholm), da kuma ƙarfin motsawa a bayan Hukumar Duniya ta 1983 kan Muhalli da Ci gaba (WCED, ko Hukumar Bruntland). Ka'idar kariya

Don kare muhalli, Jihohi za su yi amfani da tsarin kariya a ko'ina bisa ga iyawarsu. Inda akwai barazanar mummunar lalacewa ko wanda ba za a iya juyawa ba, ba za a yi amfani da rashin cikakken tabbacin kimiyya a matsayin dalilin jinkirta matakan da suka dace don hana lalacewar muhalli ba.
Ka'idar na iya taka rawa a kowane muhawara game da buƙatar tsarin muhalli.
Rigakafi
[gyara sashe | gyara masomin]- Ma'anar rigakafi ... watakila ana iya la'akari da shi a matsayin babban burin da ke haifar da hanyoyin shari'a da yawa, gami da kimantawa na baya game da cutar muhalli, lasisi ko izini wanda ya tsara yanayin aiki da sakamakon keta ka'idojin, da kuma karɓar dabarun da manufofi. Ƙayyadaddun fitarwa da sauran samfurori ko ka'idojin tsari, amfani da mafi kyawun dabarun da ake da su da irin waɗannan dabarun ana iya ganin su azaman aikace-aikacen manufar rigakafi.[13]
Ka'idar mai gurɓataccen
[gyara sashe | gyara masomin]Mai gurbatawa yana biyan ka'idar cewa "farashin muhalli na ayyukan tattalin arziki, gami da farashin hana yiwuwar cutar, ya kamata a sanya shi a ciki maimakon a ɗora shi a kan al'umma gaba ɗaya. " [14] Duk batutuwan da suka shafi alhakin farashi don Gyara muhalli da bin ka'idojin kula da gurbatawa sun haɗa da wannan ka'idar.
Yawancin yarjejeniyoyin kasa da kasa da ke da doka sun ƙunshi yankuna daban-daban, daga gurɓataccen ƙasa, ruwa da yanayi har zuwa namun daji da kariya ga halittu masu yawa. Yarjejeniyar muhalli ta kasa da kasa galibi Yarjejeniyoyi ne na bangarori da yawa (ko wani lokacin yarjejeniya ta Biyu), yarjejeniya, yarjejeniya, da dai sauransu. Duk da yake hukumomin da suka ba da shawara, suka yi jayayya, suka amince, kuma a ƙarshe suka amince da yarjejeniyar kasa da kasa da ke akwai sun bambanta bisa ga kowane yarjejeniya, wasu tarurruka, gami da Taron Majalisar Dinkin Duniya na 1972 kan Muhalli da Ci gaba, Hukumar Duniya ta 1983 kan Muhalli, Taron Majalisar Dokoki na 1992 kan Muhalli mai dorewa, da Taron Duniya na 2002 sun kasance da mahimmanci. Yarjejeniyar muhalli ta bangarori da yawa wani lokaci suna haifar da Ƙungiyar Duniya, Cibiyar ko Kungiyar da ke da alhakin aiwatar da yarjejeniyar. Manyan misalai sune Yarjejeniyar Ciniki ta Duniya a cikin Dabbobi da Flora masu haɗari (CITES) da Ƙungiyar Duniya don Kula da Yanayi (IUCN).
Dokar muhalli ta kasa da kasa ta haɗa da ra'ayoyin kotuna da kotuna na kasa da kasa. Binciken da ya gabata ya gano cewa matakin ci gaban tattalin arziki da darajar ɗabi'a ta shafi bin ka'idojin muhalli. Kasashe masu tasowa kamar Amurka, EU, da Ostiraliya suna kira ga dokoki mafi kyau da ke da niyyar rage tasirin muhalli. Ya kamata a lura cewa akwai alaƙa kai tsaye tsakanin ci gaban tattalin arziki da nisan tsakanin doka da ɗabi'a. Kasashe masu tasowa suna da kyakkyawar dangantaka tsakanin dokokin muhalli da dabi'u na ɗabi'a. Idan tsarin shari'a na kasar ya rabu da dabi'un ta gaba daya, mutane bazai bi dokokin ba kuma za su rasa muhimmancin su da tasiri. Duk da ka'idojin muhalli, ruwa a cikin Kogin Ganges na Indiya ya kasance matalauta a matsayin misali.[16]
A duk faɗin duniya

[gyara sashe | gyara masomin]A cewar Cibiyar Nazarin Muhalli da Harkokin Muhalli (INECE), manyan Batutuwan muhalli a Afirka sune " fari da ambaliyar ruwa, gurɓata iska, sare daji, asarar halittu masu yawa, wadatar ruwa mai laushi, lalacewar ƙasa da ciyayi, da kuma talauci mai yawa". " Don cimma waɗannan manufofi a Afirka, shirye-shiryen EPA suna mai da hankali kan karfafa ikon aiwatar da dokokin muhalli da kuma bin su na jama'a.[18] Sauran shirye-shiryen suna aiki akan haɓaka ƙa'idodin muhalli masu ƙarfi, ƙa'idodi, da ƙa'idori.[18]
Asiya

[gyara sashe | gyara masomin]Tarayyar Turai ta ba da dokoki na biyu game da batutuwan muhalli waɗanda ke aiki a duk faɗin EU (wanda ake kira ka'idoji) da kuma umarni da yawa waɗanda dole ne a aiwatar da su cikin dokokin ƙasa daga kasashe mambobi 27 (kasashe na ƙasa). Misalan su ne Dokar (EC) No. 338/97 akan aiwatar da CITES; ko cibiyar sadarwa ta Natura 2000 tsakiya don yanayi & manufofin bambancin halittu, wanda ya ƙunshi umarnin tsuntsaye (79/409/EEC / canza zuwa 2009/147/EC) da umarnin mazaunin (92/43/EEC). Wanda ya kunshi SACs da yawa (Zone na Musamman na Karewa, wanda ke da alaƙa da umarnin mazaunin) & SPAs (Zone masu Karewa na Musamman, wanda ke hade da umarnin tsuntsaye), a duk faɗin Turai.
Dokar Tarayyar Turai ta yi mulki a cikin Mataki na 249 Yarjejeniyar Ayyukan Tarayyar Tarayyar Duniya (TFEU). Batutuwa don dokokin EU na yau da kullun sune:

A watan Fabrairun 2024, Majalisar Tarayyar Turai ta amince da dokar da ta yi babban lalacewar muhalli, da gangan, "wanda za'a iya kwatanta da Ecocide" wani laifi wanda za'a gaje shi da shekaru 10 a kurkuku. Ya kamata membobin Tarayyar su shigar da shi cikin dokarsu ta ƙasa, na tsawon shekaru 2. Har ila yau, majalisar ta amince da dokar sabunta yanayi wacce ke tilasta wa membobin su dawo da kashi 20% na yanayin halittu da ya lalace (ciki har da kashi 30% na turɓaya) nan da shekara ta 2030 da 100% nan da shekara de 2050.

Yankin teku
[gyara sashe | gyara masomin]Babban damuwa game da batutuwan muhalli a Yankin teku sune "sakewar iska da gurɓataccen ruwa ba bisa ka'ida ba, cinikin katako / katako ba bisa ka- doka ba, jigilar sharar gida ba bisa ka 'yanci ba, gami da sharar gida da jiragen ruwa da aka tsara don hallakawa, da kuma rashin isasshen tsarin hukuma / rashin ikon tilasta aiki".[20] Sakatariyar Shirin Muhalli na Yankin Pacific (SPREP) kungiya ce ta kasa da kasa tsakanin Australia, Tsibirin Cook, FMS, Fiji, Faransa, Kiribati, Tsibirin Marshall, Nauru, New Zealand, Niue, Palau, PNG, Samoa, Tsibirin Solomon, Tonga, Tuvalu, Amurka, da Vanuatu .[21] An kafa SPREP don samar da taimako wajen ingantawa da kare muhalli da kuma tabbatar da ci gaba mai ɗorewa ga tsararraki masu zuwa.[22]
Ostiraliya

Dokar Kare Muhalli da Dokar Kare Muhimmanci ta 1999 ita ce muhimmiyar doka ta muhalli a Ostiraliya. Brazil

Kongo (RC)
